Thank you for visiting our online store. These Terms of Service (hereinafter – the “Terms”) set out the conditions for the use of the online store, ordering, purchase and sale of goods, as well as the rights and obligations of the parties.

These Terms are prepared in accordance with the Civil Code of the Republic of Lithuania, consumer protection legislation, and European Union distance selling requirements.

1. General Provisions

1.1. By using the online store and placing an order, you confirm that you have read these Terms and agree to comply with them.

1.2. The following persons have the right to purchase from the online store:

  • Legally capable natural persons;
  • Minors from the age of 14 with parental or guardian consent;
  • Legal entities acting through authorized representatives.

1.3. The Seller has the right to update these Terms at any time. The updated version will be published on the website.

2. Conclusion of the Contract

2.1. The purchase–sale contract is considered concluded from the moment the Buyer places and pays for the order.

2.2. After placing an order, the Buyer receives an order confirmation by email.

2.3. The Seller reserves the right to refuse to fulfill the order if:

  • It is not possible to contact the Buyer;
  • Payment is not confirmed;
  • The product is no longer available due to a technical error.

3. Orders and Payments

3.1. Orders may be placed online through the electronic store.

3.2. We accept payments via credit/debit cards and electronic banking.

3.3. Payments are processed only in euro currency (EUR) through our partner “Montonio Finance”, UAB.

3.4. Payments can be made via electronic banking services including Swedbank, SEB, Luminor, Citadele, Revolut, Artea, LVH, N26. Payments are also accepted via Visa and Mastercard payment cards, as well as Apple Pay and Google Pay.

3.5. Your personal information required for payment execution and confirmation may be transferred securely to “Montonio Finance”, UAB in accordance with applicable data protection requirements.

3.6. Order processing begins only after successful payment confirmation has been received.

4. Product Prices

4.1. All prices are indicated in euros (EUR).

4.2. The Seller reserves the right to change prices without prior notice; however, the price valid at the time of order placement and payment shall apply.

5. Delivery of Goods

5.1. Delivery terms, timeframes, and prices are provided in a separate Shipping Policy or during checkout.

5.2. The Buyer undertakes to provide accurate delivery details.

5.3. The Seller is not responsible for delivery delays caused by couriers or circumstances beyond the Seller’s control.

6. Specifics of Food Products

6.1. “Smart Bite” sells freeze-dried food products; therefore:

  • The appearance of goods may slightly vary due to the natural properties of ingredients.
  • Storage conditions and expiry dates are indicated on the product packaging.

6.2. The Buyer must follow the product storage and usage instructions.

6.3. Product information is provided for informational purposes only and does not constitute medical advice.

7. Withdrawal and Returns

7.1. Returns are handled in accordance with the Return Policy.

7.2. Exceptions to the right of withdrawal may apply to food products due to hygiene and safety requirements.

8. Limitation of Liability

8.1. The Seller shall not be liable for damage caused by improper use or storage of the product.

8.2. The Seller shall not be liable for website malfunctions resulting from technical issues or third-party actions.

9. Intellectual Property

All intellectual property related to the website content belongs to “Smart Bite, MB” and may not be used without prior written consent.

10. Governing Law and Dispute Resolution

10.1. These Terms are governed by the laws of the Republic of Lithuania.

10.2. Disputes shall be resolved through negotiations, and if unsuccessful, in accordance with the laws of the Republic of Lithuania.

10.3. Consumers may обратиться the State Consumer Rights Protection Authority (VVTAT) or use the EU Online Dispute Resolution (ODR) platform.
